Kioskwell terms of service

These terms are between you (the business using Kioskwell to run a directory) and Great Work LLC, 651 N Broad St, Suite 206, Middletown, DE 19709, USA ("we"). By installing or using Kioskwell you agree to them.

The service

Kioskwell publishes local business directories you create, lets business owners claim and update their listings, records their agreement, forwards visitors' requests by your rules, adds owners and visitors to your CRM, and features listings that owners pay for with your own products.

Your responsibilities

  • You run the directory: you decide what's listed, and you are responsible for its content, for having the right to publish it, and for answering owners who ask to change or remove a listing.
  • Import only business lists you are allowed to use. Don't use Kioskwell to publish people's private details, to pose as a business, or for spam.
  • Have a lawful basis to contact owners and visitors (the claim agreement records the owner's; your own privacy policy should say how you use their data), and honor opt-outs.
  • You set the price and terms of featured listings and deal with the owners who buy them, including refunds. We only read the payment to feature the listing.
  • Keep owner links private. Reset an owner's link if it's shared by mistake.

Billing

Kioskwell is billed through your CRM's app marketplace after a 14-day free trial, by the number of live directories: $249 per month (1), $499 per month (up to 5) or $799 per month (up to 15) per business account, or ten times the monthly price per year, unless the listing shows otherwise. A directory past your plan's limit is paused until the plan goes up. Refunds follow the marketplace's refund policy.

Availability and changes

We work to keep the service available but don't promise it will be uninterrupted, or any search ranking for your directory. We may change features; if a change removes something important, we will tell you in advance where we can. We may update these terms; continuing to use the app after an update means you accept it.

Liability

To the extent the law allows, the service is provided "as is", and our total liability for any claim is limited to what you paid for Kioskwell in the 12 months before the claim. We are not liable for listing content, disputes with owners or visitors, emails that weren't delivered, or indirect or consequential losses.

Ending

You can stop at any time by uninstalling the app or clicking Disconnect, which deletes your data and takes the directory offline. We may suspend accounts that misuse the service or don't pay.

Law

These terms are governed by the laws of the State of Delaware, USA.
