Punchkeep terms of service

These terms are between you (the business that installs Punchkeep) and Great Work LLC, a Delaware company at 651 N Broad St, Suite 206, Middletown, DE 19709, USA ("we"). By installing or using Punchkeep you agree to them.
The service
Punchkeep keeps prepaid session credits for your clients: it adds credits when payments for the products you link are made (or when you or your workflows add them), uses and returns credits as bookings on the calendars you choose are made, cancelled or attended, shows each member their balance, checks members in at your front desk, writes balance fields on the contact and starts your workflows through its triggers. It records credits; it does not take payments, issue refunds of money or decide your refund policy.
Credits react to events your CRM sends us. If your CRM does not send an event (for example, an appointment changed while the app was disconnected), the balance may need a manual adjustment in the app. Punchkeep acts on a booking after the booking exists, so it can flag or cancel a booking made without credits but cannot stop it from being made.
Plans, billing and trial
Punchkeep is sold through your CRM's app marketplace, which handles billing. Each install includes a free trial (currently 14 days) and then renews monthly or yearly at the price shown on the listing until you uninstall. Plans include unlimited members, packages and check-ins for one business account, subject to fair use. Refunds follow the marketplace's refund policy. Your CRM provider may separately charge a per-run fee for marketplace workflow actions and triggers.
Your responsibilities
You set the packages, expiry dates and cancellation rules and tell your clients about them, and you are responsible for honoring the credits your clients bought, including any rules on prepaid services or gift certificates where you operate. Keep your front desk link private, as anyone holding it can check members in. Do not use Punchkeep to break your CRM provider's terms, to access other customers' data or to overload the service.
Your data
Your data stays yours. We process it only to provide Punchkeep, as described in the privacy policy at https://hl.greatwork.company/packs/privacy, and delete it when you uninstall. Export what you need (the member list and ledger are shown in the app) before uninstalling.
Availability and changes
We work to keep Punchkeep running and fix problems quickly, but it is provided "as is" without warranties of any kind, to the extent the law allows. We may change features; if we make a change that removes something you rely on, we will tell you in the app first.
Liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, lost profits or lost data, and our total liability for any claim is limited to the amount you paid for Punchkeep in the 3 months before the claim.
Ending
You can stop at any time by uninstalling. We may suspend an install that breaks these terms, after notice when practical.
Law
Delaware law governs these terms, without regard to conflict-of-law rules.
